CFTC Rule 4.41 – Hypothetical or Simulated Performance Disclosure

Hypothetical or simulated performance results have certain inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, since the trades have not actually been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity.

1. Not Financial Advice

The tools, models, indicators, signals (including the 10-Factor Confluence Engine), and forecasts on SparkQuant are published solely for educational, analytical, and informational purposes. SparkQuant is not a registered investment advisor, commodity trading advisor (CTA), or broker-dealer.

2. High-Risk Asset Warning

Foreign exchange (Forex), contracts for difference (CFDs), commodities (Gold Spot), and digital assets (Cryptocurrency) carry substantial risk of loss and are not suitable for all investors. Leveraged trading can work against you as well as for you.

3. Platform Intellectual Property

All proprietary algorithms, including Dynamic Time Warping (DTW) search patterns, Intracandle Footprint visualizers, Gamma Exposure (GEX) profiles, and Confluence Scoring logic, are the exclusive intellectual property of SparkQuant Technologies Inc. Reverse engineering or unauthorized distribution is strictly prohibited.

4. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of New York and the federal laws of the United States of America.
